Sports Law Lecture: You’ve won before CAS, now how to make sure you get paid?

This lecture will focus on the means available to creditors seeking to recover monetary claims based on awards rendered by the Court of Arbitration for Sport.

It will examine to what extent creditors can resort to “internal” mechanisms to enforce CAS awards within the sports federations. It will also discuss the enforcement of CAS awards before the state courts within and outside Switzerland. The lecture will consider, in particular, the seminal SV Wilhelmshaven case, showing that creditors may face significant hurdles in enforcing awards in some jurisdictions. Finally, the discussion will cover the available means to attach funds held by international sports federations located in Switzerland.

The presentation will be largely based on or inspired by the author’s own experience in these types of proceedings.

Speaker: Fabrice Robert-Tissot, Ph.D. from the University of Fribourg, Switzerland and an LL.M. from Columbia Law School

Fabrice Robert-Tissot specializes in international commercial and sports arbitration. He has acted as counsel, arbitrator or secretary to the arbitral tribunal in numerous international arbitration proceedings. He regularly appears as counsel before the CAS and before the Swiss state courts in sports and commercial arbitration-related disputes.  As a Swiss and New York-qualified attorney at law, he has gained significant experience in corporate, commercial and sports matters.
