An ECJ ruling in Case 320/03 Commission v. Austria (sectoral prohibition on road transport by lorries of over 7.5 tonnes) on Irish heavy goods transportation may have implications on Dublin Corporation proposals to ban heavy-goods vehicles in the centre of Dublin during the day time. In its judgement the ECJ made it clear that the Austrian authorities should have proposed an alternative for transportation of the goods.
The only alternative to the Dublin Port Tunnel will be through the city itself.
Dublin Port is the Ireland's biggest entry and exit point for export/import goods. However, the EU law obliges member states to allow the free movement of goods services and people, except where there is no hindering of environment or public health
