Conformity check Packaging Directive

The tasks will consist of the following items:
1 - Search of Dutch legislation and case law for one Directive
1.1. Collect relevant legislation
1.2. Collect case law at national level as appropriate.

2 - Draft conformity study of the Directive listed below following the format provided:
• Directive 2004/12/EC
2.1. Completing the Table of Concordance (ToC): The purpose of the detailed ToC is to help identify any conformity issue. On the basis of the blank ToC provided by Milieu, analyse all transposing legislation and then completing the ToC with an acceptable level of detail.
2.2. Complete the Conformity Study: A template for the Conformity Study will be provided by Milieu. The Conformity Study must not simply repeat the problems that were identified in the ToC. Instead, the Study should contain a judicial analysis of the conformity problems (i.e. draw on relevant EU or national case law) and should highlight for the Commission the most serious conformity problems whilst also flagging up any other less serious issues.
2.3. List all pieces of legislation analysed
2.4. Summarise compliance checking findings into a summary data-sheet.

3- Provide electronic versions of all national transposing legislation, on request.

4- Provide timely responses to DG ENV & Project Management requests for clarifications, including on the ToCs, draft CS and interim and final report.

5- The expert will, if necessary, attend a workshop at a date set by Milieu according to the availability of the experts.

Topic

Checking the conformity of dutch legislation on packaging waste with the European legislation on this topic.

Objective

To provide the Commission with legal information on conformity of laws, regulations and administrative provisions adopted by The Netherlands, with a view to transposing one Directive under the contract “Conformity checking of measures by Member States to transpose Directives in the sector of environment” (No. 070307/2008/517839/FRA/A2).
