Legal Aspects of Better Regulation: European and Ukrainian Approaches

Project description

This project comprised Round Table sessions (10 persons), research, a training seminar (40 persons) and a publication for civils servants affiliated to the Legislation Institute of the Verkhovna Rada of Ukraine. On the premise that “Regulation is essential to achieve the aims of Public Policy” the focus or central element of this project was to undertake action to enable better/smarter regulation in Ukraine.




The sustainable development of society depends, inter alia, on the efficiency of regulation provided by the state and the public sector. Almost all spheres of public life – government and administration, social, health, culture and education, migration, justice, judicial, law-enforcement, security and defence systems, economics (in part), are to be regulated appropriately to provide citizens with services and guarantee their social, political and economic rights. The results of the “stagnation” period of the last years in Ukraine (economic crisis, unemployment, poverty, “brain drain” etc.) can be surmounted by introducing and following rules and methods of better regulation.

The project is intended to promote better/smarter regulation tools. This is done in a comparative manner, by analyzing both Ukrainian and European best practices

Topic

Promotion of the implementation of the EU recommendations on better regulation in Ukraine; learning from the Dutch practical experience and legislation concerning better regulation.

Objective

To join efforts of the Dutch and Ukrainian experts in law, working for the state agencies, in order to:

1) assess the impact of the EU recommendations on better/smarter regulation in legal terms;
2) to elaborate approaches on implementing them into Ukrainian legislation and administrative practice;
3) to provide the Ukrainian decision-makers with recommendations and knowledge on improvements which will be of importance with a view to the future EU-Ukraine Association Agreement and the EU-Ukraine Deep and Comprehensive Free Trade Agreement, current legislative approximation activities within the framework of the European Neighbourhood Policy and Eastern Partnership initiative.

Elaborating approaches to implement the EU recommendations on Better Regulation into Ukrainian Law, legislation and practice
- Suggesting improvements to regulatory and legislative processes through the integrated use of effective tools
- Providing the possibility of strengthening cooperation between the Dutch and Ukrainian experts in the field of law and public administration (professional consultations, exchange of experience, and training)
- Publishing the findings of the project by the Legislation Institute of the Verkhovna Rada of Ukraine
