The Law of War and Military Operations in the Courtroom: Thoughts from the Gotovina Case


The Gotovina case highlights the linkages between international criminal accountability and the conduct of military operations.  How the law is applied in any one case goes beyond the culpability of the individual charged in that case and affects how training, doctrine and planning of operations work to ensure the lawful conduct of future operations. This lecture will explore and discuss the tensions inherent in this fascinating relationship between prospective planning, real-time operations, and post-hoc criminal processes.
